agree to be bound by the following Terms & Conditions. If you do not agree with any part of
these terms, you must refrain from using this website or our services.
You further represent and warrant that you are of legal age of consent in your jurisdiction.
Individuals under the legal age of consent are not permitted to access or use this website or
our services.
By submitting an order and/or making a payment, you confirm that you have read,
understood, and accepted these Terms & Conditions. This agreement constitutes the entire
understanding between you and Penguin Publishers regarding the use of our services.
Definitions
- "Website": All online content on www.penguinpublishers.org.
- "Customer," "You," "Yours": Refers to you and/or any person submitting an order to Penguin Publishers on
your behalf.
- "Company," "We," "Our": Refers to Penguin Publishers, a company registered under the laws of the State.
- "Products or Services": All services and deliverables provided by Penguin Publishers in accordance with
the customer’s order.
- "Order": A request made by the customer via phone, e-mail, or website to purchase services, confirmed by
down payment via check, credit card, cash receipt, bank wire transfer, Western Union, or PayPal
transfer.
Refund Policy
Refunds are available under limited and specified conditions. Because of the nature of our services, once a
stage of the project has been completed and delivered, that stage is considered fulfilled and is not
eligible for refund. Our team progresses to the next stage only after completion of the prior stage, and
revisions are applicable only to the stage currently being delivered.
1. Change of Mind (Voluntary Cancellation)
- Within 24 hours of order placement: Refund is issued minus a processing fee of USD 250 or 10% of the
order value, whichever is higher.
- Upto 48 hours but before work begins: Refund is issued minus 20% of the order value or USD 250,
whichever is higher, to cover allocation and resource allotment.
- Once work has been assigned but no deliverable shared (upto 2 weeks): The same rule as above applies
(20% of the order value or USD 250, whichever is higher).
- After any deliverable is shared (e.g., mockup, draft, or sample): Change-of-mind refunds are no longer
available. Revisions are provided only for the stage currently in progress.
- Stage completion rule: Each completed stage is marked fulfilled, and no refunds apply to stages already
delivered.
- If the client has signed up and not shared the requisites for upto a week, the client shall only be
entitled to a refund of 5%.
2. Verified Non-Delivery of Services
If our team is unable to deliver a particular service despite multiple revisions, and there is a
confirmed failure on our part to meet the agreed requirements, a refund will be processed
for the undelivered service only, after deducting applicable charges as outlined above.
3. Refund Processing
- All approved refunds will be processed only to the original payment method used at checkout.
- Refunds may take 5–15 business days to reflect in the client’s account.
- Refund requests outside of the conditions stated in this policy will not be entertained.
Client Responsibilities
- Clients must provide timely input, instructions, and feedback at each stage.
- Failure to provide required input or delays in feedback may limit eligibility for revisions or refunds
and may impact project timelines.
Compliance & Dispute Resolution
All refund or dispute requests must be submitted to the Compliance Team through the
assigned Project Manager. Upon receipt, the Compliance Team will review the case and
conduct an internal audit. This process is typically completed within 3–5 business days,
after which the outcome will be communicated directly to the client.
Requests will only be processed once reviewed and approved by the Compliance Manager.
The Company is committed to resolving concerns fairly and transparently in direct
coordination with the client, ensuring the process remains streamlined. Both the client and
the Company agree not to involve third parties until the matter has been addressed in
accordance with these Terms & Conditions.
Intellectual Property Rights
- All drafts, mockups, and deliverables remain the property of Penguin Publishers until full payment is
received.
- Upon full payment, ownership of the final deliverables is transferred to the client.
- The Company retains the right to use samples of non-confidential, publicly available work for portfolio
or marketing purposes.
Confidentiality
- The Company will treat all client information, manuscripts, and materials as confidential and will not
disclose them to third parties without written consent, except as required by law.
- The Company is not responsible for breaches of confidentiality arising from information already publicly
available or supplied inaccurately by the client.
Limitation of Liability
- The Company shall not be liable for any indirect, incidental, or consequential damages arising from the
use or inability to use our services.
- The Company’s liability under any circumstance is limited to the total amount paid by the client for the
specific service in question.
Force Majeure
The Company shall not be held responsible for any delays or failure to perform services due
to causes beyond its reasonable control, including but not limited to natural disasters,
internet outages, government actions, labor disputes, or other unforeseen events.
Amendments
The Company reserves the right to update or revise these Terms & Conditions at any time
without prior notice. Any changes will be posted on www.penguinpublishers.org, and
continued use of our services constitutes acceptance of the updated terms.
